Cine beneficiază de anularea impozitului pe venitul din agricultură

Prevederile îi vizează pe agricultorii impuși pe bază de normă de venit, care au înregistrat pagube în cursul anului 2013 din cauza fenomenelor meteorologice nefavorabile.
Astfel, se va anula, proporțional cu gradul de calamitate al producției agricole, impozitul pe venitul din activități agricole datorat pentru anul fiscal 2013 de contribuabilii care au desfășurat activități agricole individual sau în asociere, dacă sunt îndeplinite cumulativ următoarele condiții:
- impozitul a fost stabilit pe bază de norme de venit;
- pentru producția agricolă nu au fost încheiate polițe de asigurare;
- producția a fost calamitată în proporție de peste 30%.
Gradul de calamitate se dovedește cu procesele-verbale de constatare a pagubelor, pentru fiecare producător agricol și unitate ori subdiviziune administrativ-teritorială, întocmite de către comisiile locale pentru situații de urgență constituite prin ordin al prefectului, potrivit dispozițiilor legale în vigoare.
Organul fiscal va emite decizia de anulare a impozitului și, după caz, a obligațiilor fiscale accesorii aferente acestuia, chiar dacă împotriva actelor administrative fiscale prin care au fost stabilite s-au exercitat ori nu căi de atac. Contribuabilii care au plătit deja contribuțiile vor beneficia de restituirea sumelor achitate.
Procedura de anulare a impozitului pe venitul din activități agricole, inclusiv a obligațiilor fiscale accesorii va fi stabilită prin ordin al ministrului finanțelor publice.
